Mississippi environmental regulators are seeking civil penalties that could reach about $6.1 million from the parent company of SpaceXAI over land disturbance at data center sites in Southaven, Mississippi.
The Mississippi Department of Environmental Quality issued notices of violation in August to MZX Tech, the parent of SpaceXAI. The notices allege the company disturbed land at three Southaven sites without the state stormwater permits required for that work. The sites are the data center, which carries the name MACROHARDERR, a power plant, and a nearby 51-acre parcel the company recently acquired in a land swap with the city.
The department is seeking civil penalties of up to $25,000 per day. Its preliminary claimed exposure for the company is about $6.1 million.
MZX Tech addressed the matter in a quarterly filing with the U.S. Securities and Exchange Commission. The company stated that it is cooperating with the department and is in discussions to resolve the matters through a single agreed order. The filing disclosed the proceedings under an SEC threshold of $1 million in expected monetary sanctions.
Southaven is in DeSoto County, on the Mississippi side of the state line within the Memphis metropolitan area. The three sites form part of the SpaceXAI data center footprint in the region, where the company has been building computing capacity and on-site power generation.
Separately, the NAACP has filed a lawsuit over gas-fired turbines on Stanton Road in Southaven. The suit alleges violations of Clean Air Act permitting requirements. A federal judge in that case recently denied a motion to end the lawsuit.
